Terms of Service

These Terms of Service govern your access to and use of Miragium, including our website, dashboard, creative import tools, AI generation features, social publishing tools, and billing features.

Agreement

These Terms of Service ("Terms") are between you and Miragium SAS ("Miragium", "we", "us", or "our"). By creating an account, using the service, or accessing the dashboard, you agree to these Terms.

If you use Miragium on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms.

The service

Miragium helps users research creative references, import source material, generate marketing assets, manage product workspaces, adapt ads, and prepare or publish content. We may update, add, limit, or discontinue features as the product evolves.

Accounts and security

You must provide accurate account information and keep your login credentials secure. You are responsible for activity under your account and for managing access to your workspace.

You must notify us promptly if you believe your account or workspace has been compromised.

Your content and permissions

"Customer Content" means content you submit, upload, import, connect, approve, generate, or publish through Miragium, including product pages, brand materials, prompts, reference URLs, social account configuration, images, videos, captions, and generated outputs.

You retain ownership of your Customer Content. You grant Miragium a worldwide, non-exclusive license to host, copy, process, analyze, display, transmit, modify, and create outputs from Customer Content as needed to provide, secure, support, and improve the service.

You are responsible for having all rights, licenses, consents, and permissions needed to use Customer Content with Miragium and to use, publish, or distribute generated outputs.

AI outputs and review

Miragium uses automated systems and third-party AI providers. Outputs may be inaccurate, incomplete, similar to third-party content, or unsuitable for your intended use. You are responsible for reviewing, approving, and legally clearing outputs before publishing or using them commercially.

Miragium does not guarantee that outputs will be unique, non-infringing, platform-compliant, or effective for any campaign.

Third-party platforms

Miragium may integrate with third-party services such as TikTok, Meta, social publishing providers, payment processors, AI providers, storage providers, and analytics providers. Your use of those services may be subject to their own terms, policies, limits, and availability. Miragium is not responsible for third-party platform decisions, outages, takedowns, API changes, or account restrictions.

Acceptable use

You may not use Miragium to:

  • Violate laws, regulations, or third-party rights.
  • Create, import, publish, or promote deceptive, infringing, harmful, hateful, exploitative, or illegal content.
  • Scrape, import, or use content in a way that violates a platform's terms or your contractual obligations.
  • Reverse engineer, overload, disrupt, or bypass limits of the service.
  • Use Miragium to build a competing service or benchmark the service without our written permission.

Plans, credits, and billing

Paid features may require a subscription, usage-based credits, or add-on purchases. Prices, included credits, usage limits, and plan features are shown at checkout or in the dashboard and may change for future billing periods.

Unless stated otherwise at checkout, fees are non-refundable except where required by law. You authorize our payment provider to charge your selected payment method for applicable fees, taxes, renewals, and add-ons.

Beta and experimental features

Some Miragium features may be beta, experimental, or subject to capacity limits. Beta features are provided as-is and may change, fail, produce incomplete outputs, or be discontinued without notice.

Miragium intellectual property

Miragium and its software, workflows, interfaces, models, templates, prompts, documentation, trademarks, and brand elements are owned by Miragium or its licensors. Except for the limited right to use the service under these Terms, we do not grant you any rights in Miragium intellectual property.

Suspension and termination

We may suspend or terminate access to Miragium if you violate these Terms, create risk for the service or other users, fail to pay fees, or use the service in a way that may expose us or others to liability. You may stop using Miragium at any time.

Disclaimers

To the fullest extent permitted by law, Miragium is provided "as-is" and "as available" without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, or error-free operation.

Limitation of liability

To the fullest extent permitted by law, Miragium will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, reputational harm, or business interruption. Our total liability for claims relating to the service will not exceed the amounts you paid to Miragium for the service in the three months before the event giving rise to the claim.

Indemnity

You will defend, indemnify, and hold harmless Miragium from claims, damages, liabilities, losses, and expenses arising from your Customer Content, your use of outputs, your violation of these Terms, or your violation of law or third-party rights.

Governing law

These Terms are governed by the laws of France, without regard to conflict of law rules. Unless applicable law requires otherwise, disputes will be resolved by the competent courts of Paris, France.

Changes to these Terms

We may update these Terms from time to time. If changes are material, we will take reasonable steps to notify users. Continued use of Miragium after changes become effective means you accept the updated Terms.
